Thank you for choosing to use Maxine Global, LLC’s mobile app ("the App"). Please carefully read these Terms of Use ("TOU") before using the App or any services provided through it. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, please do not use the App. These TOU form a legally binding agreement between you and Maxine Global, LLC.).
The App provides registered members access to premium third-party providers where each member can purchase and or reserve selected services. By registering a membership in the App, you agree to pay the membership amount and to be bound by these TOU. Memberships will auto-renew at the end of each period and will be charged to the preferred payment method designated in your Account, after which you will receive a receipt. These payments will continue and will be autocharged to the preferred payment method on file unless cancelled or paused in advance. All services can be purchased or reserved for yourself or for other people listed in your account. Some services may have a variance of charges upon final completion of services and you agree to pay these variances via the payment method on file. Any charge variance will be auto-charged to the payment method on file upon completion of services and you will receive a receipt. Charges paid for services by you are final and non-refundable, unless otherwise determined by Maxine Global, LLC. Requests for cancellations, refunds, or returns, or if you feel a correction should be made to any charge you incurred, please submit a request via the Contact Us options in the App. Such requests must be submitted within 30 days after the Charge took place or Maxine Global, LLC will have no further responsibility and you waive your right to later dispute the amounts charged.
You are solely responsible for your use of the App and any content you submit or share through the App. You agree to use the App in compliance with all applicable laws and regulations and not to use the App for any unlawful or unauthorized purpose. You also agree not to use the App to:
The App and its content, including but not limited to text, graphics, logos, images, and software, are the property of Maxine Global, LLC or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use the App or its content without our prior written consent.
THE APP AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MAXINE GLOBAL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR ITS CONTENT.
You agree to indemnify and hold Maxine Global, LLC and its officers, directors, employees, and agents harmless from any claims, damages, or expenses arising out of your use of the App or your violation of these TOU.
Maxine Global, LLC reserves the right to modify these TOU at any time, with or without notice. Your continued use of the App after any such modification shall constitute your acceptance of the modified TOU.
These TOU shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflicts of law provisions. Any dispute arising out of or in connection with these TOU shall be resolved exclusively in the state or federal courts located in Delaware.
